Illinois began recognizing same-sex marriages on June 1, 2014, as well as the pre-existing Civil Union Act that allowed any couple to be legally joined. If the people involved desire, the civil union could convert to a marriage after fulfilling certain obligations.
Legislators created the original civil union partnership rules to afford any two adults, either same sex or different sexes, the same or similar legal rights as a married couple has. These include protections for people who end their relationship under the Illinois Marriage and Dissolution of Marriage Act. The end result is that individuals in either a newer same-sex marriage or a civil union both have legal protection and rights that are generally indistinguishable and independent of what term is used for the particular relationship.
``After going through two attorneys that did nothing for me but run up my bill, I was glad to find Joel Levin and his law firm. I have never met an attorney who was so sharp and intelligent. He always looked out for my best interest.``
Problems may still arise due to the fact that some states do not currently allow either same-sex marriages or civil unions of any type. If a couple moves out of Illinois or separates during an out of state move, they may find themselves unprotected by the same laws and guidelines. The US Supreme Court did stop the Defense of Marriage Act (DOMA), but unfortunately, legal battles still continue between individual states and the federal court system. In order to understand all the intricacies of same-sex legally recognized unions, consulting with an experienced attorney is essential.
